Understanding and Applying Rule 40
Understanding and Applying Rule 40
Presented by Becky Eikmeier, Program Services Consultant/QDDP

Did you know that even though 245D will soon be in effect, Rule 40 will continue to apply to individuals with developmental disabilities? Don’t be left unaware – come and learn about Rule 40, which governs the use of aversive and deprivation procedures for these individuals. This course is divided into two sections designed to provide managers with understanding on the details of Rule 40. Proper understanding and implementation of these procedures is necessary to ensure respectful care of individuals.

The first section will provide information on:

  • The purposes of Rule 40
  • Established definitions of exempted, prohibited, and controlled procedures
  • When an Emergency Use of Controlled Procedure (EUCP) may be used and it’s reporting requirements

The second section will outline:

  • Applicable criteria and steps to develop a Rule 40 plan
  • Documentation requirements for the plan
  • Company and state committee reviews
  • Elements to quarterly reporting

Audience: QDDPs and/or managers who are responsible for writing and reviewing all uses of controlled procedures will benefit from this course, whether for the first time or as a refresher!

Cost:  $55.00

CEUs:  4.2 for Nurses, 3.5 for Social Workers
